An emerging renaissance in American manufacturing is staring at the oncoming threat of a global economic slowdown.

After investing hundreds of thousands of dollars in high tech equipment last year, Drew Greenblatt?s manufacturing business is beginning to see a return on that investment. Business was up 20 percent in 2011 at Marlin Steel, which makes wire baskets for industrial customers.

Exports are helping a lot. Greenblatt?s company just shipped to China a $20,000 order?made at his Baltimore, Md., factory with steel supplied by a mill in Illinois.

Low wages and low-cost manufacturing used to make Chinese markets tough?for U.S. manufacturers to break into. Today, rising wages in China are giving American companies?second thoughts about moving their manufacturing jobs to China,?Greenblatt said.

?All of a sudden, if your math says, ?I?ve got to pay the guy $7.50 an hour in Shanghai or I can hire a guy for $12 a hour in Canton, Ohio,? why would I do it in Shanghai?? said Greenblatt. ?I?ve got intellectual property issues over there, there?s no rule of law, there?s a lot of corruption. ?Plus if I make it here, I get the stuff six weeks faster: there?s no freight. So a lot of the reasons to push jobs overseas are starting to fall apart.?

Other companies are doing the same math. A report in March by the Boston Consulting Group found seven industry groups,?selling about $200 billion in Chinese-made imports, that will likely shift production back to the U.S. to duck rising costs in China. That could add between $20 billion to $55 billion to U.S. gross domestic product before the end of the decade, the authors estimated.

U.S. export gains in Chinese and other global markets will create between two million and three million?American jobs, lower the U.S. unemployment rate by between 1.5?to 2.0 percentage points?and cut the U.S. merchandise trade deficit by 25 to 35 percent, according to the study.

Demand for Chinese exports, meanwhile, is being hurt by the ongoing recession in Europe, China?s largest trading partner. The hit to China?s exports so far has been relatively mild compared to the sharp downturn that followed the financial panic of 2008, according to Carl Weinberg, chief economist at High Frequency Economics. Lost exports amount to about $300 billion - about half the losses from the 2008 downturn ? and the Chinese economy is better able to weather the loss because its large and its currency is stronger than in 2008, he said. But he figures the drop in exports hasn?t run its course and could get a lot worse.

The slowdown in China is also starting to take a bite out of the economies of smaller, emerging economies and trading partners that supply the raw materials needed to feed China?s export machine.

?Asia should be very worried if the European situation continues to unravel," said?Rob Subbaraman, chief Asia economist, at Nomura Group. ??It can handle moderate growth in Europe or the U.S. But if we start to move toward a deep recession there?s a tipping point where Asia gets hit very hard again.?

Dads, are you feeling pressure to do it all?

To be sure, China?s economy is still growing at a pace that would feel like wild prosperity in larger developed economies like the U.S. or Europe. But as the last major engine of growth, some forecasters are cautioning that the loss of Chinese demand threatens to spark a wider global slowdown that will crimp demand for U.S.-made products.

U.S. manufacturers are ?about to face a negative shock from the hit to exports from the deepening European downturn and the spreading impact on demand in other key trading partners in Asia,? said David Rosenberg, chief economist at Gluskin Sheff.

One big unknown is whether Chinese consumers will pick up the slack from the lost growth in exports. China continues to pursue an ambitious, 30-year plan to transform itself from a rural agrarian society to an urbanized manufacturing and consumer-driven economy. The ongoing flood of workers from farms to factories -- the largest peace-time migration in human history -- will continue to drive demand for new housing, cars and other consumer products.

But in the short-run, consumer spending isn?t kicking in fast enough. Retail sales, adjusted for inflation, are slowing. As the government continues to invest heavily in public products and state-owned businesses, consumer spending makes up a smaller portion of the economy than it did five years ago. More than 50 percent of the Chinese economy still relies on some form of government spending: consumers account for roughly a third of GDP ? about half the level in the U.S.

To revive growth, China?s leaders are expected to continue heavy government investment. After years of trade surpluses with the rest of the world, the government has plenty of cash to invest. But the risk now is that the government is creating a massive infrastructure and real estate bubble.

?They have been overbuilding everything to create jobs for these rural migrants,? said Harry Dent, an author and economic forecaster. ?They have 20 to 30 percent more capacity built in their main industries ?- cement, aluminum, steel, on and on. They just build stuff to create jobs? and to keep people happy. And they?ve been doing this for over a decade.?

China?s central bankers also face a difficult choice in trying to stimulate growth. The usual path of lowering interest rates could add heat to a real estate market that has already reached bubble levels in many urban areas. China?s bankers are also coping with a pile of bad loans to failing state-owned companies after an earlier round of easy credit aimed at heading off the 2008 recession.

That means easier credit may not produce the economic stimulus China?s leaders are hoping for.

?The positive, long-run outlook doesn?t give firms an incentive to invest today if China largely has all the apartments and car production lines it needs for the next couple of years,? said Mark Williams, chief Asia economist at Capital Economics.

It remains to be seen how badly U.S. manufacturers would be hurt by a wider, deeper coordinated global slowdown. Once recessions spread around the world, they become more difficult to reverse.

Greenblatt is upbeat. He sees an opportunity in export markets as competitors pull back. He also thinks the U.S. is somewhat insulated from a trade shock. Only about 10 percent of U.S. GDP comes from exports compared to the economies of China or Germany, where nearly a third of total output relies on exports.

Discussing whether China's economy could be on the brink of collapse, with Gordon Chang, Forbes columnist, and Peter Navarro, UC-Irvine business professor.

?Most American factories don?t even consider exporting -- it doesn?t even cross their mind,? he said. ?Because it?s easier sell to Denver and Duluth than it is to Denmark.?

But Dent argues that the wider cause of the global economic slowdown -- a historic shift in demographics -- will continue to weigh on global growth for another decade or so no matter how hard governments try to spur more growth.

Most developed countries are seeing their Baby Boom population peak, which slows consumer spending and adds to the cost of government-funded social programs. ?That means global growth won?t revive to historic levels for another decade, until the next generation of Millennials reaches its own peak spending years, said Dent.

?Were all slowing down,? he said. ?And China does not have good demographics going forward. They only have this export machine and urbanization and they?ve overdone both.?

(AP) ? Nestled nearly 5,000 feet beneath the earth in the gold boom town of Lead, S.D., is a laboratory that could help scientists answer some pretty heavy questions about life, its origins and the universe.

It's hard to spot from the surface. Looking around the rustic town, there are far more nods to its mining past than to its scientific future, but on Wednesday, when part of the closed Homestake Gold Mine officially becomes an underground campus, Lead's name will be known in scientific circles as the place where the elusive stuff called dark matter might finally be detected.

Unimpressed? Consider this: It's sure to earn itself a reference on TV's "The Big Bang Theory."

"This year, 2012, is going to be a very significant year because we get to turn the ... detector on and know very soon whether we have actually found dark matter or not," said Rick Gaitskell, a scientist with Brown University who has worked alongside dozens of scientists over the past few years to move forward with the Large Underground Xenon experiment ? or LUX ? the world's most sensitive dark-matter detector.

For most people, dark matter is a term that made their eyes glaze over in science class. But for Gaitskell and scientists like him, it's the mystery meat of existence.

"It makes up a huge amount of the universe," said Kevin Lesko, of Lawrence Berkley National Lab, who is the principal investigator for the Sanford Underground Research Facility.

Problem is, scientists can't see it.

"It has to be there because of its effects through gravity, but it also has to have properties that make it very unusual ? otherwise, we would have detected it already," Lesko said.

Regular matter ? people and planets, for example ? make up about 4 percent of the total mass-energy of the universe, he said. Dark matter makes up about 25 percent.

"So it's five times as much as us, and yet we've never directly observed it."

Scientists hope the lab buried 4,850 feet beneath the earth's surface will change that.

On Wednesday, Gov. Dennis Daugaard is to give tours of the underground lab for scientists, dignitaries and media. William Brinkman of the federal Department of Energy confirmed his plans to attend Tuesday, said Bill Harlan, spokesman for the research facility.

The unveiling has been a long time coming: The Homestead mine opened during the Black Hills' gold rush in 1876 and outlasted many counterparts. In the late 1990s, it still employed about 1,000 people, but as the value of gold dropped, it became clear that the mine's days were numbered. It shuttered for good in 2003.

The science community seized on the closure. Dark matter is too sensitive to detect in normal laboratories, but one so far underground would help shield it from pesky cosmic radiation. Also, the LUX detector is submerged in water, further insulating it.

Gaitskell said he's worked with 70 scientists and 14 institutions over the past four years to finally make the LUX experiment a reality.

That detector will be in the Davis Campus, named after Ray Davis, who won a Nobel Prize for Physics for an experiment he started in 1965 inside the then-working mine. Nearby in a new hall called the Transition Area will be the Majorana Demonstrator Experiment. That's aimed to search for a rare form of radioactive decay, which could help physicists understand how the universe evolved.

Experiments are set to begin this year, Harlan said. All told, the site has cost more than $300 million ? a mix of private donations and state and federal funding. Among the contributors: a $10 million Housing and Urban Development grant, $40 million from the South Dakota Legislature and $70 million from philanthropist T. Denny Sanford.

About 70 former mine workers now work for the lab. Greg King, a lifelong Lead resident, is one of them.

"The whole town was built up around the Homestake," King said. "As the property closed and people left, a lot of employees left. Now, there's a lot of excitement in town. People are very thrilled that the Homestake is once again, albeit not as a mine."

Liz Tiger, who owns a consignment store on Main Street, said the resurrection of the mine represents hope for Lead, a town of about 3,100 residents about a half-hour from the Wyoming border. Three generations of Tiger's family worked for the mining company.

"The economy up here really died after Homestake shut down," she said. "It was absolutely devastating."

Had it not been for Deadwood, Lead's higher-profile neighbor that draws about 2 million tourists a year, the town might have gone under, she said.

"I was raised through Homestake. I was very sad when it was shut down. (The mine) definitely needed to be used for something."

The Flame Virus: Spyware on an Unprecedented Scale | Tech Toinks!

Security researchers recently discovered one of the most complex instances of computer malware on record. Flame, which also goes by the names SkyWiper and Viper, has infected hundreds of computers across the Middle East and Europe. What does it do? Where did it come from? Who unleashed it?

What makes Flame so unusual is its size. It?s much larger than some of the largest malware instances that researchers have found. For instance, the infamous Stuxnet virus that was targeted at Iran?s uranium enrichment facilities several years ago was 500 kilobytes, according to Wired.?

?Flame is a?sizable?beast,? said Graham Cluley of Sophos Security, a publisher of digital security software. ?With all its components in place, it?s approximately 20MB. And this is one of the reasons why people have bandied phrases around like ?biggest? and ?most sophisticated.? Reverse engineering 20MB of code is a?sizable?piece of work.?

Researchers have only scratched the surface of what is hidden in all that code. Stuxnet (and its sister DuQu) took researchers months to figure out exactly what it did and where it might have come from. Flame will take a lot longer.?

Flame, at its core, is spyware. It has the ability to log key strokes from an infected user?s computer, use the computer?s sensors such as the microphone and Web cam to record what is being said around it, and take screenshots. It can also sniff a network to steal passwords, be spread through USB drives and local networks, and transfer data to command-and-control servers. It can infect Windows XP, Vista and Windows 7 computers.?

This is not your ordinary spyware, though. While it does have some simple and basic elements of spyware (which can key log and use the microphone as well), its sheer girth betrays a more sophisticated approach.?

Normal spyware is not hard to detect. It is usually some type of derivation of existing malware that has been repurposed by hackers and distributed through normal channels such as spam or infected websites. Antivirus companies such as Symantec (Norton), Kaspersky, Sophos, Bitdefender and others recognize the spyware shortly after it is discovered and issue a detection kit for it. Microsoft then comes out with a patch and the cat-and-mouse game between the malware writers and security companies goes on. To a certain extent, this is what has happened with Flame. Detection and removal kits have already been released by security companies including Sophos and Symantec, as well as the Iranian government.

But the size and uniqueness of Flame may prove to be more than the antivirus companies realize.?Right now, the detector kits are looking for specific instances within the Flame code to help detect the virus. For instance, code samples with ?flame? or ?wiper? are detected and blocked. The thing is, Flame is not exactly new. It has been in the wild for more than five years, perhaps in varying forms that have been added to over time. Much of Flame may have been compiled in 2011, but bits of it may be older. Flame?s ability to avoid detection over time speaks to its unique properties. Those properties could also speak to its source.

Flame also uses a unique programming language to the malware world: Lua. Lua is used primarily by game developers to create cross-platform applications for iOS and Android. It is similar to C++ but easier to update and communicate with.

?Lua is normally used for convenience,? said Liam O Murchu, operations manager of Symantec Security Response. ?As a scripting language it is much more high-level than C++ and it is easier to write in. Also, it is very easy to update the Lua part of the code and change the behavior of the threat in a very fluid and fast way. Often the Lua portion can be updated without recompiling and redeploying the software in question.?

Flame is well organized in how it communicates and translates data. In an infected machine, it can perform a variety of tasks including wiping out its own existence as well as any other malware on the machine. This is a tactic used by other sophisticated viruses ? becoming their own antivirus programs ? presumably because other, less sophisticated viruses could lead to the discovery of Flame itself. When Flame retrieves data, be it key logs or screen shots, it uses high- and low-level encryption and HTTPS to send data back to its command-and-control servers. That data is then organized into its database through MySQLite, a smaller version of MySQL database software.?

In a nutshell: Flame can control almost every aspect of the computer, disappear without a trace, encrypt its own communications and organize the data it collects. That is one smart virus.?

It is so large and smart that researchers have concluded that this was not created by a random group of hackers looking to make some money. (Now that its code is out in the wild, though, that may be part of its future.)?

?The results of our technical analysis supports the hypotheses that sKyWIper [Flame] was developed by a government agency of a nation state with significant budget and effort, and it may be related to cyber warfare activities,? stated a technical report from the Laboratory of Cryptography and System Security (CrySyS) at Budapest University of Technology and Economics.?

Should average computer users worry about Flame? The short answer is no. Kaspersky Labs, which initially reported on Flame, only found several hundred instances of Flame among its client base, most of them in Iran and Middle Eastern countries. Whoever created Flame has been aiming it at specific targets, perhaps knowing that a virus like this left unchecked in the wild could do serious damage.

?I think run-of-the-mill malware is a much more significant threat to the vast majority of computer users than Flame,? Cluley said. ?We have had zero reports of Flame from any of our customers? computers worldwide. Even Kaspersky, who appeared in the first media reports of Flame, only reported a couple of hundred infected PCs. Flame pretty much became the malware you didn?t have to worry about because of the media hoopla and antivirus products being updated in the last 36 hours or so. You imagine that whoever was behind Flame is now pretty grumpy about their malware attracting so much attention.??

Beyond Structured Settlements: Settlement Planning 2012 ...

During the past two months, S2KM attended and reviewed three national conferences that featured settlement planning issues:

?In addition to many technical and product presentations (identified and/or summarized in the above links), what did attendees learn about fundamental settlement planning issues?? And what fundamental issues still need to be addressed more directly at future conferences before settlement planning becomes a recognized profession?

Definitions - Three conference participants offered definitions for "settlement planning" and/or "settlement planner":

  • Joseph Tombs - "Settlement planning is a profession helping recipients of settlement proceeds use those proceeds to achieve post-loss goals and transition successfully to post-settlement financial life. Settlement planners represent a blend of several professionals: part tax lawyer, trial lawyer, special needs lawyer, financial planner, annuity specialist, social worker, and medical case worker."
  • Timothy Morbach - "Settlement planning requires due diligence and informed consent. In that context, settlement planning provides a framework within which settlement stakeholders are able to craft case-specific terms and conditions, legal documents, financial instruments, plus related work product, to resolve claims and achieve safe harbor reflecting their respective best interests."
  • Patrick Hindert - "The primary difference between special needs planning and settlement planning is that special needs planning includes clients whose disabilities result from many causes including but not limited to personal injury or workers compensation accidents."
  • Note - "Rule 1: Terminology" in the SSP Standards of Professional Conduct provides multiple definitions related to settlement planning including the following for "settlement planner": "a representative who provides advice and other services to a person participating in the design, negotiation or implementation of a settlement or satisfaction of judgment for the benefit of a person claiming a legal entitlement to an award of damages or other compensation.   • What professional licenses and certifications are applicable?
  • What primary laws and regulations apply to settlement planning?
  • What work product does each settlement planning team member provide?
  • Who integrates their individual work product into a settlement plan - and how?
  • When is a settlement plan appropriate?
  • What are the standard components of a settlement plan?
  • What are the product suitability and disclosure standards for settlement planning?
  • What does a settlement plan cost?
  • What other metrics (besides cost) are appropriate for evaluating the success of a settlement plan?
  • How are settlement planning team members compensated?
  • What alternative compensation methods and/or business models would allow settlement planning to become more efficient and/or reduce costs?
  • Once implemented, who has responsibility to monitor and/or amend the settlement plan?
  • What are the Defendant?s responsibilities and duties in settlement planning?

Gay-marriage foes: We'll get Maryland ballot spot

Rachel Maddow notes that support for marriage equality in Maryland has surged among African-Americans since President Barack Obama declared his support for equality.

Gay marriage opponents in Maryland said Tuesday they?ve handed in more than double the signatures required to hold a ballot referendum to squash the state?s new same-sex marriage law.

Thursday is the deadline to submit to election officials at least one-third of the 56,000 signatures needed to get the referendum on the November ballot. But Maryland Marriage Alliance, which supports defining marriage as between a man and a woman, said it handed in some 122,000 later Tuesday.


The final deadline for all signatures, which the state Board of Elections has to count and verify, is June 30. Derek McCoy, executive director of Maryland Marriage Alliance, told msnbc.com that he was confident they now had the signatures to get on the ballot but they would still continue to collect them.

?What we?re finding is that people are just engaged and passionate about this, even after Obama and the NAACP came out? in support of gay marriage," McCoy said. ?Anybody that was on the fence is no longer on the fence.?

A similar effort is under way in Washington state, where legislation approving same-sex marriage was signed into law by the governor earlier this year. Six states and the District of Columbia allow same-sex marriage, while 31 states have constitutional amendments that effectively ban gay marriage (this tally does not include California, where federal judges have ruled the amendment unconstitutional though further appeals are expected).

In mid-May, North Carolina became the most recent state to ban same-sex marriage. The day after that vote, President Barack Obama said he supported same-sex marriage, becoming the first American president to do so.

Since then, a survey of Maryland voters has shown a ?significant? uptick for support of gay marriage among African-Americans, according to results released last Thursday by Public Policy Polling, which said it did the poll on behalf of Marylanders for Marriage Equality -- the group campaigning to keep the same-sex marriage law on the books.

Some 57 percent of the state?s voters say they would support the law in November, compared to 37 percent who are opposed. Meanwhile, 56 percent of African-Americans say they?ll back the new law, with 39 percent opposed, almost a complete reversal from earlier numbers, said the polling firm.

The survey?s overall margin of error was plus or minus 3.4 percent, and for the African-American sample it was plus or minus 4.9 percent.

Nationwide, a Gallup poll released in May?revealed closer numbers, with 50 percent of Americans saying same-sex marriage should be legal, compared to 48 percent opposed. Support for gay marriage fell slightly in that poll from a record high of 53 percent in?2011, the first time a majority of Americans favored gay marriage. Opposition was 45 percent in that poll.

Kevin Nix, a spokesman for Marylanders for Marriage Equality, said his group expected opponents to get the required signatures since it was a ?low bar? to cross.

?We?re all planning on this going to a referendum,? he said.
